These Terms of Service ("Terms") are an agreement between you and Axipher Limited, a company incorporated in Hong Kong ("Axipher", "we", "us"), and govern your access to and use of the ArkQuant iOS application, this website, and any related services (together, the "Service"). By downloading, accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. About the Service
ArkQuant is an AI-assisted market-research tool. It generates structured research reports about financial instruments — covering price structure, momentum and trend indicators, volatility and related news context — together with supporting features such as market news, a macro-event calendar, learning content and a local history of the reports you generate.
3. Research and Informational Use Only — No Investment Advice
Axipher is not a broker-dealer, investment adviser or financial institution, and no content in the Service is tailored to your personal financial circumstances. Trading and investing involve substantial risk, including possible loss of principal. You are solely responsible for your own investment decisions, and you should consult a qualified professional adviser before making them.
4. AI-Generated Content
Reports and other analytical content in the Service are generated by artificial-intelligence systems from market data and other inputs. AI-generated content may be inaccurate, incomplete, out of date or otherwise unreliable, and may not reflect actual market conditions. We do not warrant the accuracy, completeness or timeliness of any AI-generated content, and you must not rely on it as a factual record or as a basis for financial decisions.
5. Market Data and Third-Party Content
Quotes, candlestick data, news and other market information are obtained from third-party sources. Such data may be delayed, estimated or inaccurate, and is provided without warranty of any kind. References to specific companies, exchanges or instruments (including their names and logos) are for identification purposes only and do not imply any affiliation with or endorsement by them.
6. License and Acceptable Use
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes. You agree not to:
- copy, redistribute, sell, sublicense or commercially exploit the Service or its content;
- scrape, harvest or systematically extract data from the Service, or access it by automated means;
- reverse engineer, decompile or otherwise attempt to derive the source code of the Service;
- interfere with or disrupt the integrity or performance of the Service;
- use the Service in violation of applicable laws or regulations, or present its output as personalised financial advice to third parties.
7. Intellectual Property
The Service, including its software, design, text, graphics and trademarks (other than third-party marks), is owned by Axipher or its licensors and is protected by intellectual-property laws. Except for the limited license above, no rights are granted to you.
8. Disclaimers and Limitation of Liability
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error-free.
To the maximum extent permitted by applicable law, Axipher and its directors, employees and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenues, data or goodwill — including any losses arising from trading or investment decisions made in reliance on the Service. To the extent liability cannot be excluded, our aggregate liability for all claims relating to the Service shall not exceed the amount you paid us for the Service in the twelve months preceding the claim (or USD 100 if you have paid nothing).
9. Changes to the Service or These Terms
We may modify, suspend or discontinue any part of the Service at any time. We may also update these Terms from time to time; the updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Termination
You may stop using the Service at any time by deleting the app. We may suspend or terminate your access to the Service if you breach these Terms or where required by law. Sections 3, 4, 5, 7, 8, 11 and 12 survive any termination.
11. Governing Law
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law rules. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong.
